Terms of service
1 Scope
These Terms of Service (hereinafter referred to as “Terms”) apply to services provided by Thomas Surmann earlymate, Friesickestr. 29, 13086 Berlin, Germany (hereinafter referred to as “earlymate”) and its users (hereinafter referred to as “Customers”). By using earlymate, the Customer agrees to these Terms.
2 Service provided by earlymate
Earlymate is a web-based software that provides AI-powered monitoring of user-defined topics and information sources. Any content, analyses, reports or notifications that may be provided are for informational purposes only.
No specific outcome, completeness, accuracy or timeliness of results is owed.
Use of the platform requires registration with an email address and password. Users must keep their login credentials confidential and must not share access with third parties.
3 Trial, payments and refunds
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
After registration, users may start a trial period ("Trial"). Unless canceled before the end of the Trial, the subscription will automatically convert into a paid subscription.
All payments, billing, taxes and invoicing are handled exclusively by Paddle and are subject to Paddle's terms and conditions.
Refunds may be requested within 3 days of any charge and are granted at our discretion. Refunds may be declined if the service has been extensively used. Any results obtained during the refunded period may not be used, retained or exploited for any purpose.
4 Prohibited use
Users are solely responsible for the topics, inputs and content they submit, upload or define for monitoring.
The use of earlymate is prohibited, in particular, for:
- specific investment, financial or trading recommendations
- legal, tax or medical advice
- planning, facilitating or committing criminal acts
- market manipulation, insider trading or circumvention of laws
- abusive, excessive or automated use of the platform
Users must not input, upload or otherwise process personal data of third parties unless they are legally entitled to do so. The processing of special categories of personal data within the meaning of Article 9 GDPR is prohibited.
Earlymate reserves the right to block topics or suspend accounts and there is no guarantee that any specific topic will be accepted for monitoring.
5 AI disclaimer
Earlymate uses AI-based systems. AI-generated outputs may be inaccurate, incomplete, misleading or outdated. Users are solely responsible for reviewing and verifying all outputs before relying on them. Any liability for decisions or actions taken based on the provided outputs is excluded to the extent permitted by law.
The provider does not review, monitor or verify user-defined topics or inputs for legality, correctness or suitability.
6 Usage rights & restrictions
Users are granted a non-exclusive, non-transferable right to use the platform.
Reselling, sublicensing or sharing access to earlymate without prior written consent is prohibited. The use, internal distribution and further processing of generated outputs is permitted.
Direct publication or redistribution of outputs in their original or substantially similar form is not permitted without prior written consent. Users may use outputs as input for their own editorial, analytical or informational content.
7 Availability
Continuous availability is not guaranteed. Access may be restricted due to maintenance, technical issues, third-party service failures or force majeure. Monitoring activities, updates, alerts or reports may be delayed, incomplete or temporarily unavailable.
8 Liability
The provider is liable without limitation in cases of intent and gross negligence. In cases of simple negligence, liability is limited to breaches of essential contractual obligations and to the foreseeable, typical damage.
Liability for lost profits, indirect damages, data loss and inaccurate or incomplete AI-generated outputs is excluded to the extent permitted by law. Liability for injury to life, body or health and under mandatory product liability laws remains unaffected.
The provider does not assume any responsibility for business, financial, strategic or other decisions made based on the use of the platform or its outputs.
The provider is not responsible for data loss unless caused by intent or gross negligence. Users are responsible for maintaining appropriate backups of their own data.
9 Termination
Either party may terminate the subscription without stating reasons by giving notice effective at the end of the current billing period. Notice will be given in a reasonable form, including via email or the user account.
Earlymate may suspend or terminate user accounts immediately in case of violations of these Terms.
10 Data protection
Personal data is processed in accordance with the Privacy policy.
11 Changes to these terms
The provider may amend these Terms with effect for the future. Users will be informed in a timely manner.
If a user does not object within a reasonable period, the amended Terms shall be deemed accepted.
12 Governing law & final provisions
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.
If legally permissible, the place of jurisdiction is the provider's registered office.
If any provision of these Terms is invalid or unenforceable, the remaining provisions shall remain unaffected.
